Artwork License & Content Ownership

1. Customer Ownership Representation

By submitting artwork, logos, photographs, text, or any other content ("Artwork") to Image Splash, you represent and warrant that:

• You are the owner of the Artwork, or you have obtained all necessary rights, licenses, consents, and permissions to use and reproduce it in connection with your order.
• Your Artwork does not infringe any copyright, trademark, trade secret, privacy right, or any other intellectual property or proprietary right of any third party.
• Your Artwork does not contain material that is defamatory, obscene, illegal, or otherwise violates any applicable law or regulation.
• You have obtained appropriate permissions and releases for any photographs, likenesses, or identifiable individuals depicted in your Artwork.

2. Production License Grant

By submitting Artwork, you grant Image Splash a limited, non-exclusive, royalty-free, worldwide license to:

• Reproduce, print, and otherwise process your Artwork solely for the purpose of fulfilling your order.
• Display a low-resolution thumbnail of your Artwork in our production management system to facilitate order review and communication with you.
• Store your Artwork files securely for the duration of your order and for a reasonable period thereafter to facilitate reprints.

This license is limited to production and order-related purposes only. It does not extend to any other use.

3. Image Splash Obligations

Image Splash will:

• Not use your Artwork for any purpose other than fulfilling your order.
• Not share your Artwork files with any third party except as necessary to fulfill your order (e.g., shipping or finishing vendors under confidentiality obligations).
• Not display, publish, or promote your Artwork publicly without your express written consent.
• Take reasonable technical and organizational measures to protect your Artwork from unauthorized access.

4. AI-Generated Content Note

If your Artwork contains or was created with artificial intelligence tools, you represent that you have the necessary rights to use and reproduce the AI-generated content commercially, and that it does not infringe any copyright or other intellectual property right. Image Splash does not independently verify the provenance of AI-generated content and relies on your representation. Copyright law regarding AI-generated content is evolving; you are responsible for ensuring compliance with applicable law.

5. Indemnification

You agree to indemnify, defend, and hold harmless Image Splash and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your breach of these representations or your Artwork infringing any third-party rights.
