Terms of Service

1. Acceptance of Terms

By accessing or using the Image Splash website at imagesplash.com (the "Site") or placing an order with Springboard Development Inc. dba Image Splash ("Image Splash," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site or our services.

2. Products and Services

Image Splash provides custom print products and design services. All products are custom-manufactured to your specifications and are non-returnable except as described in Section 5. Product descriptions, specifications, and pricing are subject to change without notice.

3. Ordering

By submitting an order, you represent that:

• You are at least 18 years of age.
• All information you provide is accurate and complete.
• You have the legal right to use any artwork, logos, trademarks, or images submitted with your order.
• Your order does not contain content that is illegal, defamatory, or infringes on third-party rights.

We reserve the right to refuse or cancel any order at our sole discretion, including if we determine that content violates these Terms or applicable law.

4. Payment

Payment is due at time of order unless a "pay later" arrangement is explicitly agreed upon in writing. We accept major credit cards, debit cards, and other payment methods presented at checkout. All prices are in US dollars and are subject to applicable state and local taxes.

5. Cancellations and Refunds

Because our products are custom-manufactured, cancellations are only possible before you approve your proof. After proof approval, your job enters production and cannot be cancelled. If your order arrives defective due to a manufacturing error, we will reprint or refund at our discretion. Please contact us within 5 business days of delivery.

6. Artwork and Intellectual Property

You retain ownership of all artwork you submit. By submitting artwork, you grant Image Splash a limited, non-exclusive license to reproduce your artwork solely for the purpose of fulfilling your order. You represent that you own or have the right to use all elements of your artwork. See our Artwork License for full details.

Image Splash retains all rights to the Image Splash name, logo, website design, and proprietary production processes.

7. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMAGE SPLASH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM A SPECIFIC ORDER SHALL NOT EXCEED THE AMOUNT PAID FOR THAT ORDER.

9. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the courts of Winona County, Minnesota.

10. Changes to Terms

We may update these Terms at any time. Changes are effective when posted. Continued use of the Site after changes constitutes acceptance of the revised Terms.
